Kennedy Reshapes Abortion Conflict as He Refines 'Swing Vote' Role
Legal Times
With last week's controversial Supreme Court decision on "partial birth" abortions, Justice Anthony Kennedy redefined the "swing vote" term to his liking, to mean someone who can lead and persuade the Court in a new direction. In so doing, he has introduced wrenching and controversial new language into the abortion debate, while seeming to telegraph to liberals on and off the Court the message: "Don't think I can easily be swayed, especially when fundamental morality is at stake."
Gonzales Hearing Showcases Policy Shift
Legal Times
During Attorney General Alberto Gonzales' hearing last week, crucial details emerged about how management of the Justice Department has changed during the Bush administration. Gonzales' testimony revealed a department that has lowered the traditional walls between the White House, Main Justice and the U.S. Attorney's Offices in the field, former Justice officials say. And that could have a profound impact on the way the department carries out its business in the future.
Did Cocktail Party Chatter Cause Law Firm to Breach Fiduciary Duty?
Texas Lawyer
Four years after Cox Smith Matthews settled a suit on behalf of Total Clean LLC for $4.5 million, the San Antonio-based firm is defending itself in a case brought by its former client. According to the petition, as the trial date approached, a firm shareholder told Total Clean "that the federal judge told her at a cocktail party that he would only permit a trial lasting five days." An attorney for Total Clean says his client would not have settled the case if not for the alleged misrepresentation.
A Lawyer and an Ass Walk Into a Courtroom ...
Texas Lawyer
After a neighbor complained that his son's pet donkey was a loud nuisance, Dallas lawyer C. Gregory Shamoun brought the donkey, known as Buddy, into a courtroom to attempt to prove otherwise to a jury. Questions about Buddy's behavior arose in a suit Shamoun filed, accusing neighbor John Cantrell of assault. Cantrell alleged in a counterclaim that Shamoun intentionally interfered with his enjoyment of his property by allowing a burro and a calf to roam freely in Shamoun's backyard.
Attorney Hit With $6.6 Million Malpractice Verdict
The Legal Intelligencer
A lawyer who is now with Montgomery McCracken Walker & Rhoads was hit with a legal malpractice verdict of more than $6.6 million in a suit brought against her and her former firm by a corporate real estate client that said her poor drafting of a lease agreement sparked a lawsuit in California that cost $4 million to settle. In his verdict from a nonjury trial, a judge ruled that attorney Karen Senser and Segre & Senser must reimburse Crown Cork & Seal the $4 million, as well as attorney fees and interest.
Former Admissions Director Sues Elite N.Y. School Over Diversity
New York Law Journal
The former admissions director of one of New York's most elite private schools can go forward with an unusual breach-of-contract suit accusing Riverdale County School of faking a commitment to diversity in its student body. A judge ruled that Shereem Herndon-Brown was not an at-will employee because his offer letter stated his salary would be paid in "twelve monthly installments." Herndon-Brown claims the school intended to use him as "window dressing" while maintaining discriminatory practices.
Quirky Criminal Bills Take Regulation Too Far, Critics Say
The National Law Journal
In Texas, it may soon be a crime to miss parent-teacher conferences -- just one of a wide assortment of transgressions that legislators in different states are considering making subject to criminal punishment. Some commentators see the latest wave of bills as part of a dangerous tendency toward overcriminalization. One expert cautions that politicians are misusing criminal law as a tool "to signal that they are serious about whatever the social problem of the month is."
Title Clash: When Law Firms and Their Former Attorneys Disagree
The Legal Intelligencer
After a lateral move earlier this month by an intellectual property partner from Reed Smith left the two sides disputing the defecting attorney's title while at Reed Smith, some interesting insights appeared into how attorneys are permitted to market themselves in large law firms. The question then arose: Should firms allow attorneys to take on titles that bring with them no delegated responsibilities but could potentially present marketing opportunities for the firms and attorneys?
Legal Thinkers Clash in Debate on U.S. Surveillance
Special to Law.com
Better more domestic surveillance than another Sept. 11-type attack on U.S. soil? That was the question in a lively, sold-out debate at the Asia Society's New York headquarters Wednesday night. Six panelists -- including New York Times best-selling author David Frum and ACLU President Nadine Strossen -- squared off over questions such as war's influence on the need for surveillance and technology's role in balancing privacy and security.

Commentary: Why Our Boutique Decided to Go Big
The Recorder
Marcus Topel and William Goodman had total independence and lots of high-profile work. So why did they decide to merge their seven-attorney firm in the San Francisco Bay Area with a 230-lawyer firm in New York? The two criminal defense lawyers explain that no matter how successful their firm was, they felt unremitting pressure to bring in more business and to service virtually all of the clients -- not to mention meeting the ever-increasing associate and support staff salary demands of the current market.

Smaller Telecoms Seek a Second Line
Legal Times
Small, rural telecom providers historically have looked to the United States Telecom Association for political muscle in Washington. But in recent years, they have become frustrated because they feel the USTA has shifted its focus to industry giants such as AT&T and Verizon instead of looking out for the rank-and-file. With an evolving industry, divisions between small and rural carriers, and a Democratic Congress that will push for greater federal oversight, this is the USTA's moment to prove its mettle.

Calif. Bar Still Wants Insurance Disclosure Rule The Recorder After California Bar leaders announced last year that they might require lawyers to tell clients if they don't carry malpractice insurance, complaints began pouring in from attorneys concerned that clients would be more apt to sue, or that the resulting costs would drive them out of business. Friday the Bar's Insurance Disclosure Task Force intends to recommend the proposal be tweaked to address some complaints, but still seems to think disclosure is the right way to go. N.Y. DA Says Former Judge, Assemblyman Hold Keys to Probe of Buying and Selling Judgeships New York Law Journal With the bribery conviction of former Justice Gerald P. Garson in hand, Brooklyn District Attorney Charles J. Hynes said Friday that "the end game" of his office's four-year probe into the buying and selling of judgeships is about to begin. Hynes said Garson and former Assemblyman and Brooklyn Democratic county Chairman Clarence Norman hold the "keys" to proving allegations that candidates have had to pay $50,000 or more to obtain judgeships, stories that "have been around longer than you or me." |
